Not dissapointed at all that the thread was created, it was a topic worth discussing and some good things can be taken from it in terms of what is and isnt acceptable from both fans and players and just human interaction in general as it is still very much a problem that occurs in every day life, some people still don't even realise what is and isn't a racial remark.

Has it been proven that all of this was fake or has some out of the press mediation taken place, surely some words had to be exchanged it's a pretty big lie to make up from scratch.

The way I see it is the incident happened. Shane felt the pressure and then with his big $$$$ got his solicitor to go after Che. Che probably then crumbled feeling that it wasn't worth possibly getting sued and then also having to pay legal bills as well. In a heresy case it is hard to prove who said what. So Che would not have a strong enough case. Unless witness did actually hear all that was said and were willing to testify.

Fair point King plus you know Heal could call on his team mates as witness' to back up his story.

Ah what the heck, I'll chip in. The guy who made the allegation, lives for his basketball, he's a character for sure, but I doubt he'd make up a story to big-note himself.
My thoughts: Heal realised he was in deep shit, contacted Xxx through his lawyer & they work out a hush (not saying money's exchanged) deal that best for basketball. Xxx figures if it went public, it could hurt the league which he dearly loves, so wears the crap.
I guess you guys mightn't operate that way, but a top little bloke like Xxx may have.

If Che was serious about this as he makes it out to be he would have posted that video or given it to the news, he could easily clear up the audio so we could hear what Heal said, but that didn't happen, why? cause hes a little shit who made it all up to get some attention and now it all back fired on his ass... if anything he should be banned from NBL games for rest of season... see if he brings this so called video up then

I read on the original post on OzHoops that he said the audio was inaudible. Guessing if the footage was usable then the retraction would not have happened.

Could still have been pressured into a retraction by threats of a drawn out and expensive legal case.

If...the video/audio exists, then the "victim" of the abuse and racial villification has nothing to fear, no matter how much money the "accused" has access to.

If it were to make it to court, the tape would prove the abuse, the case would be found in favour of the "victim" and court costs would also be awarded against the "accused" (in almost all cases).

This says to me one of two things occured...

1) Never happened, the "victim" got carried away and made the allegations and now wishes they had not.

2) all true, the accused went to the victim and offered some sort of compensation to drop the issue.

I am guessing we will never know for sure, whuich is just how both parties would like it.

Cesar openly admitted that the video was inconclusive and only captured the last moment of the exchange. Lawyers threatened litigation unless Cesar retracted his comments. He's not going to find freebie lawyers in a your-word-vs-mine case against a guy with a portfolio of around $12m or so. And he's not going to have the other witnesses back him against that legal threat - too risky.

This is actually not at all true. Defamation cases (assuming that's what this would have been) do not necessarily hinge on truth, and this varies from state to state.

The existence of a crystal clear recording would not stop a case going ahead, even if it did automatically mean the action failed (which I pointed out above is not the case), meaning the "retract or incur significant legal expenses defending yourself" threat would still be just as compelling.

Generally speaking, abusing somebody because they've retracted critical comments on a forum and suggesting that must mean the comments were made up to begin with displays an incredible naivete of how the world works.

People who think Blowjoggs/Ces made this up are either fanatical Heal supporters not willing to accept the truth or just plain ignorant.

I don't know Ces/Blowjoggs personally but have read a very large number of his posts on Ozhoops. He provides an informative, funny and entertaining view on the game and is on the money with most of his remarks. His view is also generally unbiased and his passion for basketball evident.

Heal has always been a classless act, its not hard to believe he would of done something like this.
