Hoops FNBL Round 10

Hey all

Round 9 results will be posted tomorrow morning.

Mark Dickel (guard) is added to the FA List. Im sure we will probably have a couple more imports added in the next few days as well.

All Free Agents are restricted until 9am Tuesday, From now on as well, anyone delisted will automatically be restricted for 24 hours and then available without restriction.

I had to mnually work out Eddie Shannons score as Virtual Sports didnt include him this week.
I worked it out as 10. Im sure X can probably confirm this. (He seems to know more about how the scoring works, but I am pretty sure I got it right)

Obviously makes no difference to the results, but does slightly to the ladder percentage for Beantown and Lockie. I have fixed it at my end.

Actually, I may have jumped the gun....

Bean has to confirm that he's happy for the trade to go down. The Commissioners (skip) did ask the question, and Bean hasn't responded with a 'yes' or 'no'.

Mind you, once a players is mentioned in a trade where one party has agreed, can the players owner then drop/waiver him without notified the other trading party.. Should the players owner formally decline the trade before dropping the player??? Smells like Donald Sterling..

I was riding with you and Bizzy X, but after reviewing the trade that I did, it did have to be confirmed by skip. Bizzy has a conflict of interest on this decision :)


I call a meeting of all owners to vote on this one and throw up some questions.

1) Was the trade finalised???

In my opinion, it wasn't as Bean didn't confirm he was happy for the trade to go down.

2) Was Braswell (or Brasswell) Bizzy's player at the time Bean waiver him.

In my opinion, Braswell (or Brasswell) was still Bean's player as the trade hadn't been confirmed or finalised by the Commissioner.

Very much a Donald Sterling scenario.....

My view is the trade between Bean and Bizzy hadn't been confirmed.

An offer was made to "test the waters". Bizzy agreed to the offer but Bean had not confirmed the trade and decided it was not in his best interests. If you cannot put a proposal to someone to "test the waters" trades will never happen!

Precedence has been set earlier on in the year when I believe Skip did offer Penney (prior to coming back to the NBL) to me and I agreed, but Skip did not confirm, therefore trade did not proceed.

And then just last week, DB agreed to a trade I proposed last week but because I did not confirm it did not go through - a better offer was made.

I propose to keep the trade process as it stands now as I think it works, but think if it is not in the rules, it needs to be added.

Hmmm interesting offer X. Sticking points would be Shannon - I'd prefer to keep him over Howard - and the fact that I'm trading two players who have played 9 games for two who have played 11. Let me think it over, but if you'd take Howard instead, I'm more likely to agree.

The law regarding offer and acceptance only requires an offer by party A, with all of the fundamental terms defined with sufficient clarity, that remains open for acceptance (that is, not withdrawn) at the time party B communicates (or in this case, posts) an acceptance.

Bizz, it might be worth your while appealing the decision!

I would have thought if the 'three-way handshake' rule was going to be in place (that is: offer, acceptance, confirmation), you would want that written fairly clearly into the rules.

If you don't want to be bound by an offer you make, either don't make the offer or make it clear it is not an offer capable of acceptance.

Well, my view, and this has always been the case with this League is..

The initial Offer is a 'verbal offer'. This then needs to be followed by the 'contract signing' of both parties. So both need to then confirm they are happy with the trade.

as for the 'Law' Screw that! I AM THE LAW!

If you have a car/house to sell, and offer it for sale separately to two different people, and then both accept before you can withdraw one offer, you have two enforceable contracts to settle on. A dilemma unless you have two identical cars/houses to sell, which is of course impossible. Breach of contract here we come!

The 'you must sign the contract' line doesn't necessarily work either. Contracts can be oral and yet enforceble, even when there is an intention to enter into a more formal written contract. Depends on whether there is certainty as to the terms of the contract.

Here though, with both offers being open and known to the offerees, you can probably rely on an implied term of 'first in best dressed'.

Skip, not entirely true. Yes, there is the old Statute of Frauds (UK) requirement (Law of Property Act SA) that an interest in land be executed in writing.

But nevertheless an oral agreement in relation to an interest in land, that has been part-performed by the parties, can in exceptional circumstances give rise to a binding contract. Similarly, the Statute of Frauds may not protect a person who relies on the 'executed in writing' requirement to knowingly defraud a purchaser.

But kiddies, if you want to buy a house, make sure you get a contract in writing.
